Warranty rights


Trust may be included in any contract as fulfilment of an additional obligation. Many contracts include an additional stipulation to withhold the purchase price or a fee in order to ensure fulfilment of warranty and guarantee obligations. Although the stipulation provides insurance for the party using the service, there is little guarantee for the other party to receive the amount due to it once the warranty, guarantee period expires if the warranty, guarantee has not been enforced. If the parties agreed on withholding in order to ensure performance of the warranty, guarantee obligations and do so by involving a trustee, both parties have ample guarantee of contractual performance.
